Abstract
The company’s clientele plays a fundamental role in assessing the severity of
a disciplinary dismissal. Employee interaction with customers is an essential element of the work process, and inappropriate conduct that damages the company’s reputation, impairs service, or causes economic or image-related harm may justify dismissal. This study aims to analyze the role of clientele in evaluating disciplinary dismissals for verbal or physical offenses [art. 54.2 c) of the Workers’ Statute] or for habitual drunkenness or drug addiction [art. 54.2 f) of the Workers’ Statute]. It examines how case law considers whether such conduct occurs in the presence of company customers or, in the case of offenses, whether it is directed at them.
