Abstract

The Judgment of the Spanish Supreme Court of 17 October 2025 is of particular
significance, as it constitutes the first ruling of the Fourth Chamber addressing key
concepts such as the notion of «transnational» for the purpose of determining the scope of the information and consultation rights of European Works Councils and their effective exercise. Its relevance is further heightened considering the recently adopted Directive 2025/2450. The interpretative guidance provided by the Judgment is especially valuable for the future transposition and practical implementation of this new regulatory framework. Accordingly, an indepth examination of the Judgment delivered by the Social Chamber of the Supreme Court is warranted to clarify how essential concepts, such as the meaning of «transnational» and the extent of the rights conferred upon European Works Councils, are to be understood.
