The right to an equivalent number of days off: workers’ right to compensation where a weekly rest day coincides with a public holiday (in light of Supreme Court judgment 372/2025 of 30 April)

Abstract

This article provides a brief commentary on the Supreme Court’s case-law regarding whether or not an employee is entitled to a public holiday when it coincides with their weekly rest day, with particular emphasis —in our view— on the purpose-based approach adopted by the Supreme Court in the aforementioned judgment: «entitlement to the same number of rest days».
