Arquitectura normativa del urbanismo e integración del entorno físico: análisis comparado entre el modelo neerlandés y el catalán

Resumen

El artículo analiza comparativamente el marco normativo del urbanismo en los Países Bajos y en Cataluña, tomando como referencia la Ley del Entorno neerlandesa (Omgevingswet) y el sistema urbanístico catalán en el marco constitucional español. Desde una metodología jurídico-estructural, el estudio examina el diseño institucional como elemento determinante de la capacidad de integrar políticas públicas y afrontar los retos de la sostenibilidad. La comparación identifica dos racionalidades diferenciadas: un modelo neerlandés integrado y adaptativo, basado en la unificación normativa y la ponderación conjunta de intereses, y un modelo catalán sectorial y garantista, centrado en el planeamiento como delimitación ex ante de derechos y en la coordinación procedimental. El trabajo concluye que la sostenibilidad opera como criterio estructurante del diseño jurídico y que cada sistema redistribuye de forma distinta las tensiones entre flexibilidad y control, integración y seguridad jurídica.
