De los niños de los Andes a las ancianas de los Alpes: Nuevos hitos en la protección del medio ambiente y frente al cambio climático a través de los Derechos Humanos

Los órganos jurisdiccionales regionales de derechos humanos se enfrentan a casos cada vez más complejos y de creciente calado en los que ciudadanos y Organizaciones No Gubernamentales denuncian el impacto de la degradación de nuestro entorno y los efectos del cambio climático tienen en sus derecho fundamentales. Algunas de estas denuncias están propiciando decisiones judiciales de gran trascendencia, que marcan un punto de inflexión en la doctrina de estos tribunales, introduciendo nuevos elementos conceptuales y abriendo también nuevos interrogantes. Este es el caso de las recientes sentencias de la Corte Interamericana de Derechos Humanos en el asunto Habitantes de la Oroya, y del Tribunal Europeo de Derechos Humanos en el asunto KlimaSeniorinnen Schweiz. Dos asuntos que abordan el impacto en los derechos humanos de dos problemas ambientales distintos (el primero los efectos de la contaminación masiva en una “zona de sacrificio” en los Andes, y el segundo los efectos del cambio climático en ancianas suizas), y en dos sistemas regionales de protección de los derechos humanos con notables diferencias, pero que en ambos casos importantes hitos en la protección del medio ambiente a través de los derechos humanos. Tienen, además, interesantes puntos de conexión, como la dimensión colectiva del derecho a un medio ambiente sano, o la búsqueda de mecanismos para avanzar en el principio de equidad intergeneracional y en la protección de las generaciones futuras. Y no puede excluirse un cierto grado de mutua influencia a la hora de abordar estos problemas.
